1. Acceptance of Terms

By accessing or using serp.systems ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.

3. User Accounts

3.1 Registration & Authentication

To use certain features, you must create an account. User authentication is handled by Clerk, a third-party authentication provider. By creating an account, you agree to:

Clerk manages your authentication credentials (passwords, sessions, and identity tokens) on our behalf. We do not directly store your passwords. Your use of Clerk is also subject to Clerk's terms of service.

You are responsible for safeguarding access to your account and for any activities or actions taken under it. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. Subscription Plans & Payments

4.1 Plans and Pricing

We offer various subscription plans with different features and usage limits. Current plan details and pricing are available on our website. We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.

If you are an EU consumer, you have a 14-day right of withdrawal from the date of purchase under Directive 2011/83/EU. During checkout, you are required to consent to immediate access to the service, thereby waiving your 14-day withdrawal right in accordance with Article 16(m) of the Consumer Rights Directive. 4.4 Credit Packs

In addition to subscription credits, you may purchase one-time credit packs. Credit packs are non-refundable and do not expire. Credits are consumed in the order: monthly subscription credits first, then extra credit packs.

4.5 Cancellation

You may cancel your subscription at any time from your billing dashboard or the Stripe customer portal. Upon cancellation, your access will continue until the end of the current billing period. No partial refunds are issued for the remaining days of a billing cycle.

You retain ownership of content you input into the Service (prompts, keywords, instructions). You grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

Please note: Because content is generated by Anthropic's Claude AI model, similar or identical content may be generated for different users given similar inputs. We do not guarantee the uniqueness of any generated content.

6.3 Our Content

The Service itself — including its design, features, user interface, documentation, and branding — is owned by serp.systems and is protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or brand elements.

Important: All content generated through our Service is produced by Anthropic's Claude AI model. AI-generated content should always be reviewed, fact-checked, and edited by a human before publication or use.

You may request account deletion at any time through the account settings in your dashboard. Upon requesting deletion, your account will be deactivated and scheduled for permanent data removal after a 30-day retention period. During this period, you may cancel the deletion and reactivate your account by logging in and visiting settings.

We may terminate or suspend your account immediately, without prior notice or liability, for reasons including but not limited to:

Upon termination, your right to use the Service ceases. User-initiated deletions undergo a 30-day retention period before permanent data removal. Terminations initiated by us may result in immediate data deletion. Data stored by third-party providers (Clerk, Supabase) will be handled according to their respective data retention policies.

  1. Good faith negotiation between the parties for a period of at least 30 days

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

We may modify these Terms at any time. We will provide notice of significant changes via email or through a prominent notice within the Service at least 15 days before they take effect. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and serp.systems regarding your use of the Service and supersede all prior agreements, communications, and proposals.
